A trade mark protects the parts of your brand that make it exclusively yours. For most businesses, that comes down to two things.

Your name or words.
The brand name, product name or tagline your customers know you by. Usually registered in plain font, which gives you the broadest protection, so you’re covered however it’s styled.

Your logo.
The visual mark itself, with or without words. Many businesses register their name and their logo as two separate trade marks, so the name stays protected even if the look changes down the track.

A trade mark can also cover less common things:

Here’s how "cheap" trade mark services catch you out

A lot of online trade mark registration services advertise a low price, then add government fees, class fees and extras at checkout. We don’t. Our fees are fixed for 1 trade mark in 1 class. We are contactable unlike other online trade mark application platforms.

Applied Marks trade mark packages include the government filing fee for one class. The price only changes if your brand needs protecting across more than one class, and we’ll show you that cost upfront.

What’s a class?
Trade marks are registered in categories, called classes, based on what you sell. A clothing label and a café fall into different classes. Pick the wrong one and your protection has gaps. Our platform works out the right classes for you, so you’re covered where it counts.

Before you spend any money, we check whether your name is actually available to register. If there’s a problem, you find out first, not after you’ve paid.

How much does it cost to register a trade mark in Australia?

Trade mark registration with Applied Marks starts at $795 for one trade mark in one class, including GST and the government filing fee. Need a Little Help is $1,595 and Done For You is $2,000. The only thing that changes the price is protecting your brand across more than one class, and we show you that cost upfront, never at checkout.

You can register a trade mark yourself in Australia. However, our Do It Yourself option, the platform guides you through it and a real person checks your application before it’s lodged, so you’re never on your own. If you’d rather hand it over, our assisted and done-for-you options put a trade mark attorney on your application.

A business name lets you legally trade under a name. A trade mark gives you exclusive legal ownership of that name as a brand. Registering a business name, company name or domain does not protect your brand from being used by someone else. Only a registered trade mark does. If you only have a company registration and another company/sole trader has a trade mark registration for the same brand name, the trade mark owner will trump and claim infringement over someone that only has a company name only.

A trade mark class is a category for the goods or services your brand covers, and there are 45 of them. Most small businesses need just one. Our platform works out the right class for what you sell, and every Applied Marks package covers one class. Classes 1 to 34 are for products and classes 35 to 45 are for services offerings.

You can trade mark your name, your logo, or both. Your name (word mark) is usually the priority, because it’s how customers find you and talk about you. A logo can be registered separately for extra protection. We’ll help you decide what’s worth protecting first. We suggest that if the WORD mark is available, then it is recommended over a LOGO mark. However, we do suggest that if you can afford two trade marks, then a WORD mark and LOGO mark would give you comprehensive protection.

A trade mark search checks whether your name is available to register before you spend a cent. It’s the simplest way to avoid paying for an application that was never going to succeed. After you apply, IP Australia examines your application, usually within three to four months. If it passes, it’s advertised for two months while anyone can oppose it. If no one does, it’s registered and protected for ten years from your filing date. If it is not approved, then we will send you the adverse report.

The two most common reasons are a name too similar to one already registered, or a name too descriptive of the product itself. Our free search catches conflicts early  (via our NEED A LITTLE HELP and DONE FOR YOU packages), and our team reviews every application by hand to fix issues before it’s lodged, which is a big part of our 90% success rate if clients choses to engage us through those two packages.

If your application is rejected, we will send you an adverse report from IP Australia and we will explain the report (at no cost) and suggest options to overcome the issues if possible. We will always quote upfront fees prior to proceeding with any work, if the adverse report is too complex we will refer you to our legal colleagues within Griffith Hack (Applied Marks is a division of Griffith Hack).
